The government will deal with a new version of a draft law on mobbing

A new draft amendment to provisions on mobbing has been published. According to its provisions:

  • compensation for harm suffered in connection with repeated infringements of the principle of equal treatment towards an employee (repeated infringements for the same reason or for multiple reasons, or a single infringement for multiple reasons at the same time) will amount to at least three times the minimum wage (from 2026 - PLN 14,418)
  • the minimum value of compensation amounting to twelve times the minimum wage (from 2026 - PLN 57,672) will also apply in the case of compensation paid directly by the mobber (when the employer is absolved of liability).

The amendment is to introduce, among other things, a new definition of mobbing and an employer's claim against the person who engages in mobbing, whose actions made the employer pay compensation or damages. We wrote about the previous version of the draft on our portal.

According to the draft, the changes would enter into force 21 days after publication.
