Internships only under contracts of employment? A draft bill has been released
An contract of internship is to be deemed to be a contract of employment and remuneration is to be at least 65% of the minimum wage – these are the key provisions of the draft bill on internships (UD307) that has been prepared by the Ministry of Family, Labour, and Social Policy.
The second version of the draft is a fundamental change to the legal framework of this institution. The current proposal is that internships are to be undertaken, as a rule, under a contra t of employment, whilst there are to separate regulations for internships involving minors. This marks a departure from the originally planned civil law framework (contracts of mandate).
The draft also provides for a prohibition on temporary employment agencies placing trainees (punishable by a fine of between PLN 3,000 and PLN 30,000) and maintains limits on the number of trainees per organiser. The proposed regulations are to come into force on 1 January 2027.
