Will there be a need to prepare new HR templates?
Although we are still unaware of the exact details of the Polish provisions transposing the Pay Transparency Directive, we may already assume that the changes will require a number of new HR template documents.
As we have already explained, employees will be able to request information from their employer about how their remuneration compares with the average earnings of other employees doing comparable work. Employers will have to inform all employees annually of their right to receive information and the steps employees should take to exercise this right. In particular, we anticipate that this procedure will require new HR documentation, including a template for the annual information and a template for responding to an employee's request.
It would also be a good idea to prepare in advance a template of information for job applicants about the proposed starting remuneration or its range, as well as about the relevant provisions of any collective bargaining agreement or remuneration regulations.
Finally, as the Directive stipulates that employee representatives must be consulted on a number of issues, including those relating to how remuneration is structured or assessing a remuneration gap, we recommend preparing the appropriate template documents in this regard in advance.
